These terms apply to purchases made through emberandthorne.co.uk. They do not limit any rights you have under consumer law.
1. Who we are
Ember & Thorne is a UK online retail business operated by Owen Lea-Porter trading as Ember & Thorne.
Email: hello@emberandthorne.co.uk
Postal address:
56 Carisbrooke Drive, Southport, Merseyside, PR9 7JD
2. Products and prices
We take reasonable care to describe products accurately. Colours, natural materials and handmade finishes can vary slightly from photographs where that is inherent in the product. The price shown on the product page and at checkout is the price you pay, subject to correction of an obvious pricing error before a contract is accepted.
Ember & Thorne is not currently VAT registered, so VAT is not shown as a separate customer charge.
3. Placing an order
When you place an order, you are making an offer to buy the goods in your basket. An automatic order acknowledgement confirms that we have received the order; it does not necessarily mean that the order has been accepted. We may refuse or cancel an order if, for example, a product is unavailable, there is an obvious pricing error, payment cannot be authorised or we cannot deliver to the address supplied.
A contract is formed when we accept the order by dispatching the goods or confirming dispatch. If we cannot accept an order after payment has been taken, we will refund the amount paid.
4. Payment
Available payment methods are shown at checkout. Payment services are provided by the payment provider selected at checkout. We do not receive or store your full card number.
5. Delivery
Delivery options, charges and estimated times are shown at checkout and explained on our Delivery & Returns page. Delivery dates are estimates unless we expressly agree otherwise. Please provide a complete and accurate delivery address.
6. Your right to cancel
For most goods bought online, consumers can cancel without giving a reason within 14 days after receiving the goods, then have a further 14 days to return them. To cancel, email hello@emberandthorne.co.uk with a clear statement that you want to cancel the contract.
The cancellation right does not apply in every case. Legal exceptions can include personalised or custom-made goods and sealed goods that are not suitable for return for health or hygiene reasons once unsealed.
7. Returns and refunds
Please contact us before returning anything. For a valid change-of-mind cancellation, you will normally pay the return cost. We will refund the product price and, where required, the cost of our standard outbound delivery service. We may make a lawful deduction for loss in value caused by handling beyond what would reasonably be allowed in a shop.
Different rules apply where goods are faulty, damaged, incorrect or not as described. In those circumstances, your remedies are governed by consumer law and we will not require you to bear reasonable return costs that are our responsibility.
8. Faulty goods
Goods must be of satisfactory quality, fit for purpose and as described. If they are not, you may be entitled to a refund, repair or replacement depending on the circumstances and timing. Nothing in these terms excludes those statutory rights.
9. Use of the website
You may use this website for personal shopping and ordinary browsing. The site design, original written content, branding and other materials owned by Ember & Thorne may not be copied or commercially reused without permission. Third-party trademarks and product imagery remain the property of their respective owners.
10. Liability
Nothing in these terms limits liability where it would be unlawful to do so, including liability for fraud, fraudulent misrepresentation or death or personal injury caused by negligence. For consumer purchases, we are responsible for losses that are a foreseeable result of our breach of contract or failure to use reasonable care and skill, subject to the law.
11. Governing law
These terms are governed by the laws of England and Wales. If you are a consumer elsewhere in the UK, this does not remove any mandatory protections that apply where you live.
12. Contact
Questions about these terms or an order can be sent to hello@emberandthorne.co.uk.
